U.S. Entry Waivers - Travelling to the U.S.

Even though you might have a Canadian Record Suspension (formerly Pardon) it does not guarantee your travel freedom to the United States.
U.S. Homeland Security and the Customs Border Protection (CBP) do not recognize a Canadian Record Suspension (Pardon) as rehabilitation.
It is illegal to attempt entry into the U.S. with most you may still require a waiver to legally enter the United States of America.

If you attempt to enter the U.S. with a criminal record, CBP has the authority to deny you access — or worse.
Regardless of how long ago your charge(s), or how minor you feel they are, you are taking a substantial risk every time you attempt to enter the U.S. with a criminal record.
The US Customs and Immigration service has computer access to the Canadian Police Information System (CPIC). They can instantly determine if you have a criminal record in Canada. Once that information is in their system, it is there forever.
That criminal record will appear each and every time you attempt entry to the US.
It is the American government's decision whether to consider the existence of the conviction as a ground for inadmissibility to the United States. Grounds of inadmissibility can be found in the Immigration and Nationality Act (INA) section 212(a).

A U.S. Entry Waiver is a legal document issued by United States Homeland Security which grants advanced permission to cross the border for a specific number of years.
Once you obtain a waiver, it is valid for one to five years and must be renewed. There is a filing fee that must accompany your application for a waiver.
